INVITATION TO BID
1.0 Notice is hereby given that the Owner, Tillamook People's Utility District (TPUD), will receive sealed bids for the construction of a Generator Building and Installation of an Owner-Provided Generator according to the Drawings and Specifications prepared by Kennedy/Jenks Consultants and accepted by the Owner and described in general as: Facility Generator Upgrade Project.

3.0 Sealed bids marked "Tillamook PUD Facility Generator Upgrade Project Bid EnclosedDue By Thursday, 22 July 2010,2:00 PM" will be received at: Tillamook People's Utility District 1115 Pacific Avenue Tillamook, OR 97141-0433
Bids will be received until 2:00 PM local time, 22 July 2010. Bids received after that time will not be accepted. No bid will be considered responsive unless the sealed envelope containing First-Tier Subcontractor List and bearing the bidder's name and project title has been received on or before 4:00 PM. on the bid date. This form must be submitted even if there are no First-Tier subcontractors. Failure to submit the First-Tier Subcontractor List by the disclosure deadline will result in a nonresponsive bid. Bids will be opened in public and read aloud at 2:00 PM local time 22 July 2010 at the Tillamook People's Utility District Office at 1115 Pacific Avenue Tillamook, OR 971410433.

4.0 Bid security in the amount of 5% of the bid amount, made payable to the Owner, is required to accompany each bid. Bid security shall be in the form of a r.ashier's or certified check, or a Bid Bond as required by the Bid Security Document following the Bid Form, Document number 00410.

5.0 Requirements for the State of Oregon Public Works Contracts: • Each bidder must identifywhether the bidder is a Resident Bidder as defined by DRS 279A.120.
• All bidders must submit, in a sealed envelope within two hours of the date and time of the bid deadline, a First-Tier Subcontractor Disclosure Form in compliance with DRS 279C.370. • The award of the contract shall be made to the Lowest Responsible Bidder as the term is used in DRS 279C.375.
• All bidders must be willing to comply with the provisions of the Equal Employment Opportunity Act of 1972 and the Civil Rights Act of 1964.

5.1 Prevailing Wage Rates
Prevailing minimum hourly wage rates for labor to be used under this contract have been determined by the Oregon Bureau of Labor and Industries (BOLI) in accordance with DRS 279C.800 through 279C.870. BOLI prevailing wage rates shall be as published in July 2007. If awarded the contract, the Contractor shall agree to pay Bill a fee commiserate with the contract price as provided in ORS 279C.825. All Contractors working on the project must file a $30,000 "public works bond" with the Construction Contractor's Board. This bond is to be used exclusively for unpaid wages determined due by BOLI.

6.0 No bidder may withdraw its bid for a period of sixty (60) days after the time fixed for the opening of the bids, within which time an award will be made. The Owner reserves the right to reject any and all bids or to waive any irregularities or informalities in any bid or in the bidding. The Owner may reject any bid not in compliance with all prescribed bidding procedures and requirements, and may reject, for good cause, any or all bids upon a finding by the Tillamook People's Utility District that it is in the best interest of the public to do so.

There will be a non-refundable fee (including shipping) of $100 (per set) for Half Size Drawings/Project Manual. Checks should be made payable to Tillamook People's Utility District. If full-size drawings are desired, a request may be made. Full-size drawings will be reproduced at a reproduction shop in Portland. The bidder shall be responsible for all reproduction and mailing costs for the full-size drawings. No refunds for the cost of fullsize drawings will be made. Full-size drawings will not be sent to full-size drawing holders when drawings are revised and issued as addenda unless reordered. Only revised half-size drawings will be issued as necessary with addenda. Full-size drawings will contain only the revisions made to the drawings at the time of issuance.
• All interested Bidders are required to attend the Pre-Bid Conference and site tour to be held on 6 July 2010 at the Tillamook PUD property located at 1115 Pacific Avenue Tillamook, OR 97141-0433. If Bidders are unable to attend, questions may be directed to the Owner as directed in Specification Section 00010, paragraph 2.0. The project locations are shown on the drawings.
